Menendez Brothers Begin Parole Hearings in San Diego

SAN DIEGO - On Thursday, August 21, 2025, Erik Menendez, 54, appeared before the California State Board of Parole Hearings. This was the first of two “suitability” hearings for him and his brother. They were convicted in 1996 of murdering their parents in 1989.
Erik joined the board meeting through videoconference from the Richard J. Donovan Correctional Facility. He aimed to show that he no longer poses a threat to public safety. After over 35 years in prison, he believes he deserves a chance at release. His brother, Lyle Menendez, is 57. He will present his case on Friday using the same procedures.
In today’s hearing, defense attorney Mark Geragos highlighted the brothers’ growth and rehabilitation. He pointed out that each will be judged on their own merits. Geragos told the commissioners, “Each brother…stands or falls on their own.” He pointed out Erik’s remorse. Erik said at resentencing in May that he committed “an atrocious act” and felt deep regret.
Nathan Hochman and others from the Los Angeles County District Attorney’s Office attended the hearing. They were there to contest the brothers’ release. Hochman repeated his belief that Erik and Lyle “have never fully acknowledged their culpability in the tragic murders of their parents.” He said they still “perpetuate a false narrative of self-defense” that the jury rejected decades ago.
Family members of victims and supporters also participated. Over twenty relatives have written letters or spoken up for the brothers. They believe their rehabilitation is real. Uncle Milton Anderson’s opposition wasn’t able to be presented. His attorney confirmed that he lacks standing due to his death earlier this year.
Under California law, if the board finds Erik suitable for parole, a 120-day legal review period begins. Then, Gov. Gavin Newsom has 30 days to agree, modify, or cancel the recommendation. A final resolution could come early next year.
No immediate decision was announced following Erik’s hearing. The board is set to reconvene Friday morning for Lyle’s appearance. They may also decide separately for each brother.
